Listing of Primary Producers

Business operators in primary production and allied areas (including fishing vessels, aquaculture farms, ice factories, landing sites, collection centres and auction sites), which operate in the food chain intended for export to the EU Market, shall be Listed for that by QCRS, subject to compliance with EU requirements as stipulated in  Department of Fisheries Directive No 3/2009 dated 03.04.2009Download-Sept 2018:

Primary producers under inspection by QCRS and compliant with requirement may be listed on request.

 

Licensing Processing Factories

Fish processing factories bigger than SMEs producing frozen, chilled, dried and fermented fishery products in Myanmar need to have a Licence for processing by the QCRS of Department of Fisheries.  Myanmar Department of Fisheries Directive 1/2006 define SMEs to be establishments with up to 100 employees and up 5 mio. Kyats in turnover.

Licence are issued to establishments with valid Company Registration by Ministry of Commerce and valid business license from Regional City Development Committee and which comply with food hygiene and safety criteria stipulated in  DOF Directives 8/2018.QCRS  makes inspection to evaluate compliance with food hygiene and safety criteria.

 

Export Market Requirements

EU

Establishments that export fishery products to EU shall comply with general hygiene requirements in Regulation (EC) 852/2004 and specific hygiene requirements in Regulation (EC) 853/2004.  Annex II section IV on of Regulation (EC) 853/2004 have specific requirements on labeling of frozen fishery products and Annex III section VIII provide specific hygiene criteria for production of on fishery products, including specific hygiene requirements to primary production, i.e. fishing vessels and landing sites and processing of fishery products.

In addition to the general and specific hygiene criteria that apply to the business operators, the following EU legislation have most important requirements to for fishery products intended for export to EU:

Japan

  • Residues and contaminants in fishery products:Regulation for residues of Agricultural Chemicals in Foods, including pesticides and pharmacological active substances of veterinary medicines – The allowed substances and related MRLs can be seen on the Database of Japanese Chemical Research Foundation
    • Environmental Contaminants: See Guidance.
    • Residues of pesticides: Japan accept residues of a number of pesticides in different products of aquatic origin. Information about substances and their MRLs for different groups of products can be found on Database
    • Residues pharmacological active substances from of veterinary medicines: Japan prohibits the residues of certain pharmacological substances in any food including all fishery products Japan Prohibits. Japanese regulation summarized in the context of the Myanmar regulation: See Guidance.
  • Microbiological criteria for fishery products intended for export to Japan:  The standards are issued by the Ministry of Health and Welfare Notification No. 370, 1959 (latest revision: MHLW Notification No.336, 2010) under the title of “Specifications and Standards for Food and Food Additives etc”.  See Guidance
  • Food Additives The Japanese Ministry of Health and Welfare have established regulations regarding the approval and use of additives. Link The information on additives in products intended for export to Japan is published on Japanese Chemical Research Foundation.

  • Japan External Trade Organization (JETRO) have a general guidance  on export of food to Japan.

US

The establishments that intend to export fishery products to US market shall demonstrate to the importer that they comply with requirements to Good Manufacturing Practices in the US Code of Federal Regulations Title 21 Part 110 (link 21CRF110) and with the specific requirements to HACCP  in the Seafood HACCP Regulation (link: 21CFR123).

The use of additives are in US listed as GRAS (Generally Recognised as Safe) in the US regulation (link: 21CFR182). As such they may be used in accordance with the general principles of §182.1 of 21CFR182. Additives with limited use in specified products are listed in 21CFR171 and additives allowed in rinsing and washing of certain foods are in 21CFR173.

Most valuable guidance to implement the requirements of the US market for fishery products are provided in the document “Fish and Fishery Products Hazards and Controls Guidance” (Link). Annex 5 of this document also provides guidance on microbial and chemical criteria that will be applied by the US authorities at import. Fish of the Siluriforms which cover all catfish including among others species of the families Ictalurus, Clariida and Pangasius can currently not be exported from Myanmar to US. This will require specific approval of the Myanmar Authorities and establishments by US Department of Agriculture Food Safety and Inspection Services. Saudi Food And Drug Authority (SFDA)

The establishments that intend to export fishery products to Saudi Arabia market shall register to SFDA  according to the https://www.sfda.gov.sa/en/regulations/66195 & https://www.sfda.gov.sa/en/regulations/69500  and demonstrate to the importer that they comply with SFDA requirements .

 

QCRS & Department of Fishery (DOF)

Inspection and Certification Unit is a legal entity in form of a government body assigned as a Unit of the Research and Development Division of Department of Fisheries by Office Order No. 284/2016 [1] on Assignment of Quality Control and Research Section under Research and Development Division. The conditions for conducting official controls are stipulated in DOF Directive 2/2015 Department of Fisheries. QCRS liability is assumed by State in accordance with national laws.

Official controls are conducted only by staff assigned directly under QCRS or by other DOF units to which specific official control tasks are delegated by the QCRS Management (see chapter 6.3 in this manual)

Regulation

Legal Power

The Myanmar Marine Fisheries Law 1990, empowers QCRS to:

  • order the examination or sampling of products if there is reason to believe that fish or fishery products are in non-compliance with relevant legislation;
  • search premises and records if there is reason to believe that fish or fishery products are in non-compliance with relevant legislation;
  • refrain from signing Health Certificates and / or withdraw the Approval status of an establishment, vessel or other component part of the supply chain if it is reasonably concluded that fish or fishery products are in non-compliance with relevant legislation and that product may be injurious to health;
  • order cessation of production if it is concluded that consumer safety is threatened.

Legal Responsibility

Technical Regulations for Export and Import of Fishery Products DOF Directive 8/2018 Chapter 3  provides QCRS with the following responsibilities:

  • To assess and verify the sanitary operation of approved fish processing establishments, fishing industry vessels, aquaculture farms, landing sites, auctions and all means of transportation by road and water;
  • To certify exports of fish and fishery products originating in Myanmar;
  • To liaise with operators of fish processing establishment, other government agencies and importing country authorities with regard to the sanitary production of fish and fishery products and market access requirements;
  • To provide official assurance to importing country authorities of the sanitary condition and safety of exported fish and fishery products.

NRMP / Aquaculture

QCRS  implement a program for monitoring of residues of veterinary medical products and environmental contaminants in fishery products from aquaculture. The program is developed per requirement of the EU market and it is mandatory for all  establishments that intend to export products from aquaculture to EU Approved Processing Factories (Download) including  their suppliers of fish raw materials.

The Program is annual from (April-March) and every year the number of samples, sampling points and test parameters are decided based on the amount of production in the participating farms and the regulation on allowed and prohibited veterinary medicines.

The objective of the program is to :

  • Detect the illegal use of prohibited veterinary medicines;
  • Detect the illegal or wrong use of allowed veterinary medicines;
  • Collect data in support of management towards responsible management of veterinary medicines in animals intended for food.

The program is based on annually plans for sampling and testing considering:

  • Risks related with potential illegal substances on the market
  • Risk related with potential wrong use of legal substances
  • Risks related with specific potential environmental contamination in related areas (run off from farming areas, mining, etc.)
  • The amount of production in the included farms (1 sample per 100 tons production).
  • The necessary laboratory test capacity and capability
  • The results of previous year sampling and testing
  • Any specific market requirements to the program, specifically the EU Directive 96/23/EC
  • Myanmar legislation on authorization, distribution and use of veterinary medicines in products of aquatic animal origin
  • Myanmar legislation on prohibited and allowed pesticides

Annual Planning of Audits and Inspections

All business operators licensed to produce and/or store fishery products  intended for export from Myanmar are subject to regular inspection and audit.

The number of inspections/audits per year per operator is risk based including the food safety risk related with the products, and  the level of compliance.

QCRS maintains a list of establishments approved to export.  Licensed processing factories should maintain their facilities in good hygienic conditions and apply HACCP based food safety management systems adequate to ensure efficient control of hazards related with the operation and products.

Inspection of GAqP food safety of aquaculture farms

QCRS verifies that the farm conditions, facilities, procedures and practices prevent potential food safety hazards efficiently and guarantee traceability and food safety of the raw materials processed and produced. The verification of GAqP is in support to the National  Monitoring Programme for residues of veterinary medicines and environmental contaminants NRMP.

Inspection of hygiene and food safety conditions of fishing vessels

All licensed fishing vessels that request listing to supply processing factories approved for export to EU.

QCRS verifies that the vessels structure, equipment, procedures and practices prevent potential food safety hazards efficiently and guarantee traceability and food safety of the raw materials.

Any observed non-compliance with legal requirements or good handling practices should be noted and discussed immediately with the crew member/vessel representative.

Organization

The QCRS Official Control System cover all official control activities necessary to verify that fishery products, aimed for export from Myanmar, complies with the applicable food safety criteria on the relevant export markets. The official controls encompasses the ‘farm to table’ principle and are therefore conducted at all steps in the supply chain, including the rearing and fishing of living aquatic resources, on-shore handling, storage, processing and distribution to overseas markets. The official controls includes also control of inputs with direct influence on food safety, specifically feed, chemicals and veterinary medicines for aquaculture.

Approval for export to specific markets

QCRS maintains  a list of establishments approved to export to the EU Market (Download- Apriil,2024) Licensed Fish processing factories independent Cold Stores are approved on request if they comply with specific food hygiene and food safety criteria required by EU. QCRS  verifies this by document control and on-site inspection and inform the competent authority of EU (DG Sante) about the updated Approval List.

Requirements for Approval:

  • Food Safety Management System shall be HACCP based and specifically it shall document
    • supplier control ensuring only the use of raw materials from fishing vessels and farms that are listed/approved for EU (traceability)
    • that specific microbial and chemical food safety criteria are addressed as appropriate
  • For export of products from aquaculture the establishment and all farms that supply raw materials shall participate in the NRMP
  • Previous inspection reports and status of any corrective action requests shall indicate that compliance with EU hygiene requirements are achieved.

Conditions for maintaining of Approval:

The establishment shall achieve and maintain Level A or Level B in inspection and HACCP audit in order to maintain the Approval for export to EU. The QCRS have established procedures to suspend or withdraw the Approval for export to EU if the establishments do not demonstrate compliance with requirements.

Mission & Vision

The  Inspection and Quality Control Section (QCRS) of the Research and Development Division of Fisheries (DOF), Ministry of Agriculture, Livestock and Irrigation is the National Competent Authority (hereafter called the QCRS), designated to verify that fish and fishery products aimed for export from Myanmar complies with relevant food safety regulatory requirements in Myanmar and in the relevant export markets. These verification activities are hereafter called official controls.

QCRS shall facilitate market access for Myanmar fish and fishery products to the international market place, specifically ensure that all operators are well informed about relevant requirements and plan and conduct the necessary official controls in a timely, transparent and cost effective manner.

The official controls of fishery products from Myanmar shall be designed, implemented and maintained with the primary goal to protect consumers. In the event of a conflict with other interests, precedence should be given to protecting the health of consumers.

QCRS commit to continuous monitoring and improvement of their own performance, specifically to keep the organisation and individuals updated for compliance with the relevant regional and international requirements and guidelines, to which Myanmar are committed  through the WTO/SPS agreement, agreements within the ASEAN Community and specific market requirements, e.g. the EU market.

QCRS Management commit to ensure access to the necessary resources and to the planning and conducting of official controls of food safety of fishery products in a way, which can be considered impartial and reliable by all parts in Myanmar as well as on the overseas markets.

QCRS Management commit to ensure transparency in policies and principles for planning and conducting of official controls of fishery products for export; including in particular establishing and updating of the QCRS website with information about legislation, guidelines, assessment criteria, specific market listings etc., with the goal to facilitate communication with Myanmar business operators and competent authorities of export markets, without compromising confidentiality.

QCRS Management commit to ensure implementing of the policy and procedures for the operation of the Inspection and Certification Unit, as documented in this Manual, specifically to review the manual and the practices against each other at regular intervals, and to update as deemed necessary.

QCRS Management commit to ensure coordination of the objectives and activities between the accredited Department of Fisheries Analytical Laboratory (covering laboratory analysis only) and the Inspection and Certification Unit.

QCRS Management commit to define and work towards achieving measurable goals and objectives for the performance and continued improvement of the system of official control. The goals and objectives will be re-visited at least in context of the annual Management Review.

Health Certificates

All consignments of fishery products for human consumption intended for export shall have a health certificate issued by the QCRS prior to export. The health certificate confirms that the products are produced in compliance with legal requirements to food safety  and are fit for human consumption.

EU, China and GCC have their own specific health certificates that are required to be used and for other markets such as US, Japan, and ASEAN countries a general health certificate will be used.

Business operator shall apply for health certificate to QCRS.

For EU and US markets a specific application form supported by documentation shall be used and QCRS inspectors may verify the consignment on-site in the factory prior to issuing the certificate.

For other markets health certificate may be issued upon verification of required documentation for food safety.

Required support documents for export to EU and US: Download Application Form EU Health Certificate

For EU consignments that include with species scientific name, area of capture (if) leasable fishery), catch area and fishing vessel name, license no., registration no. and Jetty name (if wild capture), Farm name and License no. (if farm aquaculture), date of capture, weight of raw materials, buyer and seller name and signatures, stamp and signatures of the Township Fishery Officer.

Required support documents for other markets:

Health Certificate China, Health Certificate GCC, General Health Certificate

For Non-EU consignments that document traceability  to the suppliers of raw materials and invoice/packaging list with number of cartons per species and size, net weight and gross weight.

If all documentation and on-site or desk verification is complete, Health Certification Unit (HCU) will be issued  after receiving.

The Inspection and Certification Unit (ICU) of the Quality Control and Research Section (QCRS) of Department of Fisheries (DOF), Ministry of Agriculture, Livestock and Irrigation is the National Competent Authority (hereafter called the QCRS) designated to verify that fish and fishery products aimed for export from Myanmar complies with relevant food safety regulatory requirements in Myanmar and in the relevant export markets. These verification activities are hereafter called official controls.

QCRS shall facilitate market access for Myanmar fish and fishery products to the international market place, specifically ensure that all operators are well informed about relevant requirements and plan and conduct the necessary official controls in a timely, transparent and cost effective manner.
